           These Tips are meant to address what many people ask when they have a Bench Warrant issued for their arrest (typically due to Failing to Appear in court on criminal charges, even traffic tickets, filed against them); Violation of one or more terms of their probation, or both.)
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           1. DIY Pitfalls
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           There's an old expression, "You can do things the easy way or do it the hard way". Going to court yourself trying to handle a BW (Bench Warrant) issued for your arrest, VOP (Violation of Probation) with a BW to soon follow, or both, will take up a lot of your time, possibly cost you your job and potentially lead to avoidable jail time with a skilled criminal defense lawyer.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           2. Sit and Wait
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           If you choose to DIY, arrive at court before 7:30 a.m. After passing the security checkpoint, go to the Criminal Clerk’s Office, and wait or check with paperwork showing where to go. You wait in the court room until your case is “pulled” and given to the judge, which could take hours. Sometimes the judge will get to your case before noon and often it will be put on the afternoon calendar. You'll get the opportunity to tell the Judge why you are there and what you want to accomplish. The Judge will already know (or his courtroom clerk will direct his attention) that you have 1 or more BW (bench warrants) for your arrest and/or being in (VOP) Violation of Probation.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           3. Posting Bail
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           If the Judge is in a good mood, he (or she) will allow you to enter a plea and then set bail. Why bail? Because you will be viewed as a flight risk if you already have an FTA (Failure to Appear) that resulted in the BW being issued and/or you are already VOP and probably won't complete whatever term of probation unless he can make you come back and show proof of completion. An attorney will have wired this with a bondsman who will meet in the courtroom.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           4. Custody?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           If you don't have bail lined up beforehand through a bail bondsman, as lawyers would recommend, the Judge will order one of the Marshals/Bailiffs to take you into custody and set a Trial Readiness Conference after appointing a PD (Public Defender), if you are income eligible. If you can’t "make bail" you may lose your job while you are in County Jail awaiting a disposition on the BW/VOP charge(s).
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           5. Arm Twisted to Plead Out
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Upon returning to court (after cooling your heels in county jail), the PD, who won't know you, will "assist" you by telling you what the DA's offer is and proceed to twist your arm to accept it. Or you can think it over...remaining in county jail until your next court date. When you finally get tired of this routine, most people end up pleading guilty to 1 or more of the charges even though you may have a valid defense. About the only good thing that emerges out of this is that you'll get CTS (Credit for Time Served) which will be applied to the the sentence imposed against you on the BW/VOP.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           6. Hiring a Criminal Defense Attorney Instead
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           A skilled defense attorney can appear for you on a misdemeanor, and enter a NG (Not Guilty) plea on your behalf without you having to be personally present so you can keep your job. S/he gets the Judge to recall the warrant; set a bail reduction hearing if bail is excessive; gets copies of the criminal complaint and discovery turned over by the DA and reviews same with you, while explaining potential defenses; and asking the court to set a convenient TRC date to "turn yourself in".
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           7. Who to Hire?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Certainly not a TV/Billboard advertising lawyer. Your defense attorney, should contact the DA's office and twist their arm to get the best possible deal for you. But, don't be surprised that many attorneys don’t do anything between hearings, while telling you they're "working on it" and continue court hearings after court hearing, until you're bled dry and can't afford them anymore and then they'll drop you like a hot potato.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           8. Better Deal/Get on With Your Life
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In the long run retaining a criminal defense lawyer will likely get a better plea bargain offer, often with no jail time and reinstatement on the original terms of your probation, keep your job, so you are able to pay your mortgage/rent, car payment, other bills, etc. as well, of course, your lawyer.
          &#xD;
    &lt;/span&gt;&#xD;

  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;

           9. You Don't Have to Live in Fear
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Tired of “Black and White Fever” looking over your shoulder every time you see a police car/officer thinking to yourself, "Is the the day I get pulled over and arrested" Retain a good criminal defense lawyer BEFORE that day comes. It's not a question of IF, but rather WHEN you get taken into custody. Incidentally, if you get pulled over on a routine traffic stop, your car will be impounded costing hundreds if not thousands of dollars to get out of impound. Yet another reason to hire a criminal defense lawyer to clear the "wreckage of your past" before things get out of control. The longer you wait, the harsher the sentence.

           SR-22: What It Is and Why It Matters
          &#xD;
    &lt;/strong&gt;&#xD;

           If you lose the DMV hearing or enter a plea in court, you will need to file an SR-22 with the DMV to get your driver’s license reinstated. The SR-22 is a “Proof of Insurance” certificate provided by an insurance company that guarantees you have the required minimum liability coverage mandated by California law. It is crucial that you do not file this SR-22 through your current insurance company, as doing so could lead to an immediate increase in your premium or even cancellation of your policy. Many people walk away from a crash thinking they are fine, only to discover hours later that they are suffering from whiplash, internal injuries, or head trauma. Always get checked by medical professionals right away, either at the scene, the ER, or urgent care. That medical record becomes your first piece of evidence…as the med report in essence TESTIFIES.
          &#xD;

  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           Once safe, document everything you can. Use your phone to photograph/record the accident scene from multiple angles and get statements from all parties/wits. Capture the license plates, traffic signals, skid marks, of the vehicles involved, and weather the conditions. Take close-up pictures of any visible injuries—cuts, bruises, swelling—because these may fade quickly. Use your cell to record parties and witnesses for their names, contact information and observations.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           At the scene, limit what you say. Do not apologize, speculate, or admit fault, even casually. Simple comments like “I didn’t see you” can later be twisted by insurance companies into admissions of liability. Be polite and exchange information, but keep conversation to a minimum. Remember, it’s not what’s said. It’s what the police/adjuster, thought you said!
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

            If your vehicle is disabled, arrange for a tow (but get the car out of the tow yard asap, as the daily charges are high), and notify your insurance company. But here is the critical rule:
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           do not provide a statement to the insurance adjuster before speaking with our office.
          &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Adjusters may sound friendly, but their objective is to minimize payouts. They may offer a quick settlement, hoping you’ll accept, before realizing the true extent of your injuries and losses.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Preserve evidence carefully. Do not authorize vehicle repairs or dispose of damaged property until your attorney advises. Not everyone does this, but we send an Anti-Spoliation Letter to not destroy any evidence. Innocent posts such as “I was late to golf because of the accident,” may be used to argue you were not seriously hurt.

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

           In fact, adjusters sometimes contact your friends through social media, asking innocent-sounding questions. Without realizing it, friends may confirm your tennis, pickle ball, golf, activities that undermine your claim.

           The best practice is to suspend or lock down your accounts until your case is resolved. If you cannot, avoid posting anything about your health, activities, or lifestyle. Even private messages may be subpoenaed in litigation.

  &lt;p&gt;&#xD;

           Insurance companies may also attempt to catch you in compromising situations. Property damage adjusters have been known to ask victims to point to dents on a vehicle, then snap a photo of the person bending and smiling when they say, smile… right before the pix. This evidence is later used to argue you were not injured. Similarly, casual comments like “I’ll be fine” are recorded as admissions.

  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;

           Your credibility is the foundation of your case. Once it is damaged, recovery becomes much harder. Silence, therefore, is not avoidance—it’s protection.

The law follows the medicine, meaning that the quality, consistency, and documentation of your care directly affect the value of your claim. Failing to treat promptly, or leaving gaps in care, allows insurance companies to argue your injuries are minor or unrelated to the accident.

            The first rule is simple:

           see a doctor immediately
          &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      
           . Ideally, you should be transported by ambulance, or visit an ER or urgent care center the same day. Delays can weaken your case. Even if symptoms appear mild, underlying injuries such as concussions, spinal issues, or internal bleeding may not be obvious at first. A timely exam documents your condition and provides an official medical baseline.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Next, communicate all symptoms—from head to toe to your lawyer and EACH doctor by bringing your Accident Diary to each appointment. Pain often masks other problems, so what feels like neck stiffness, may also include headaches, dizziness, or numbness in your arms and legs. When you see your doctor, bring your diary, with a written list of every symptom. If you forget to mention something, it may never be included in your medical records, and if it is not in the record, insurers argue it didn’t exist. In essence that it didn’t happen.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Consistency is key. Attend all appointments, follow prescribed treatment, and never allow long gaps between visits. Breaks in treatment give insurers ammunition to claim you are healed. or exaggerating your injuries. Even rescheduling appointments, without explanation, may raise doubts.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Documentation goes beyond medical records. Keep copies of every bill, prescription receipt, and diagnostic test. Photograph visible injuries, and update those photos over time. If you cannot perform daily activities, such as lifting your child, exercising, or even working at your desk without pain, document these limitations in writing. Advise the doc that “it hurts when I try to do X”.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           We can often secure medical treatment on

            —agreements where doctors treat you now, and are paid later from the settlement. This ensures you get proper care, even if you cannot afford it upfront. We will will refer you to doctors

    &lt;/span&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           experienced in writing medical/legal reports…
          &#xD;
    &lt;/strong&gt;&#xD;

           ! The value of injury cases rise or fall, on the med/legal reports…the most important part of maximizing the case value and not taught in all medical schools. A doctor who simply says, “rest and take aspirin,” provides little value for proving long-term impact.

           : the strength of your case depends not only on the severity of your injuries, but also on how well they are documented in a medical report…something many local doctors were not trained to do IN THEIR MEDICAL SCHOOL. Treat promptly, be thorough, stay consistent, and let your attorney coordinate with your doctors. Proper medical care is essential, not only for your health, but also for securing the compensation you deserve.

Insurers are businesses, and their priority is profits—not your well-being. Recognizing their tactics is essential to protecting yourself.

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Their first strategy is
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           deny
          &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            and
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           delay
          &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      
           . Insurance companies know that every day your claim is unresolved, they earn money by investing funds that should go to victims. Multiply this across many hundreds of thousands of claims, and the profits are enormous. The delays in approving car repairs; providing rental vehicles; ok’ing/paying medical bills, reducing med bill payments, are all designed to wear you down. If you lack transportation, you may miss medical appointments or legal consultations, further reducing the value of your case. Thus, there is no reason for them to rush to get you a vehicle or doctor.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

            . After an accident, you may receive a call, with what seems like an easy solution: fast money in exchange for signing away your rights. The problem? Early offers rarely account for ongoing medical treatment, future pain, or loss of income. Once you sign, you

      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           can’t reopen
          &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            the claim.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           . They may sound friendly while casually asking about your activities. For example, “It looks like a great day for golf in the CV—do you play?” If you answer yes and mention a recent round of golf, they may later argue that you could not have been seriously injured. Even innocent conversations can be twisted into evidence against you.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

            Another strategy involves

           . If your vehicle shows minimal damage, insurers argue you could not have been seriously hurt. They may pressure you to use their “preferred” body shops, which often cut corners to reduce repair costs, creating lower property damage reports. These reports, in turn, are used to diminish the value of your injury claim.

  &lt;p&gt;&#xD;

           —secret surveillance, where investigators follow you, record your activities, and look for inconsistencies. If you tell a doctor you can’t lift heavy items, but they capture you carrying heavy groceries from Costco, your credibility suffers. Even if you were pushing through pain, the video tells a different story.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Perhaps most concerning, adjusters now undergo
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;strong&gt;&#xD;
      
           performance reviews,
          &#xD;
    &lt;/strong&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            based on how much money they save the company. This creates an incentive to deny legitimate claims, underpay settlements, and frustrate accident victims into giving up. One of our accident cases was just settled in late
