The Aid & Attendance Benefit For Vets, A Little Known Tax Free Pension

“Aid and Attendance is something about which very few people know”, (including me). I do NOT handle this area of law AND suggest you contact your tax lawyer to get up to date on what, if anything, you may be entitled to receive. When I came across Aid and Attendance, I knew I had to advise the public and make those who are eligible aware of something that may work for them. I just want my CV neighbors to be aware of their rights like these …and the rights you have if/when stopped by an officer for a possible DUI which I will discuss in another legal column.
For instance: Did you know the Field Sobriety Test (Walk the line, alphabet etc) and Preliminary Alcohol Breath Test at the scene, are OPTIONAL? You can elect not to take and then politely chose the Breath test at the station, or as I suggest, the Blood Test.
I hate to see people taken advantage of…like an Insurance man or women, convincing a 90 year old senior to liquidate his/her assets that were making 8%, and telling them to purchase a 10 year annuity at .016%. Believe me, it happens!
You can, and should, Google Aid and Attendance, to find an accredited representative to explain and help you fill out your claim…and contact you Tax Attorney. It is based in age, assets, marital status, income, liquid assets and cost of care. Since there are requirements, you may be advised by your tax attorney, to put your home in a living trust
The Department of Veteran Affairs offers this special benefit pension to war era veterans, and their surviving no-remarried spouses, called Aid and Attendance. Thus the government may Aid you when you need ATTENDANCE…someone to attend to your needs. This NON-Service Connected pension was established in 1952 under Title 38USC and there are two components, Aid and Attendance AND Housebound benefits.
This is a tax-free benefit designed to provide financial assistance to help cover the cost of long term care in the home, in an assisted living facility or in a nursing home.
This Benefit is for those veterans and surviving spouses who require the regular attendance of another person or caregiver in at least two of the daily activities of living such as bathing, dressing, eating, toileting, and transferring.

AID AND ATTENDANCE IS A LITTLE KNOWN VET TAX FREE PENSION, PER THE VETERANS ADMINISTRATION.
Though the AVA is a private company, and NOT affiliated with the Veteran’s Administration (VA). They claim to charge a reasonable fee…I don’t know. There are 4 KEY Q’s re: qualification? 1. Is the Vet 65 or older? 2. Did the Vet serve during a period of war? 3. Is the Veteran or non-remarried spouse currently receiving a VA benefit for a service connected injury or illness that is more than $2,000/mo? 4.
